1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of hytaleanz.com and our related services, features, and content (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Our Refund Policy forms part of these Terms and applies to all purchases of digital goods and services made through HytaleANZ.

2. Who we are and what we provide

HytaleANZ provides community features and tools, which may include server listings, creator dashboards, platform account connections, and related services. The Services may change over time, and some features may be in beta or experimental.

HytaleANZ is not affiliated with, endorsed by, or officially connected to Hytale, Hypixel Studios, Mojang, Microsoft, Twitch, Discord, YouTube, or any other third-party brand, unless we explicitly state otherwise. Third-party trademarks belong to their respective owners.

3. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Services and they are responsible for your use.

4. Accounts and security

  • You are responsible for maintaining the confidentiality of your Account.
  • You must provide accurate information and keep it up to date.
  • You must promptly notify us of unauthorised use or security issues affecting your Account.

5. Acceptable use

You agree not to misuse the Services. This includes (without limitation):

  • harassing, abusing, threatening, or impersonating others
  • posting illegal, hateful, sexually explicit, or exploitative content, or content that encourages harm
  • posting content that is defamatory, fraudulent, or knowingly misleading
  • spamming, scamming, phishing, or attempting to collect user data without permission
  • attempting to bypass security, scrape data excessively, or disrupt the Services
  • uploading malware or using the Services to distribute malicious code
  • infringing intellectual property rights (including posting content you do not have rights to use)

6. User content and licences

You retain ownership of content you submit, post, or display through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, reproduce, modify (for formatting and display), publish, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Services.

You represent and warrant that you have all rights necessary to grant this licence and that your User Content does not violate any law or third-party rights.

7. Server listings and third-party services

If the Services include server listings or directories, you acknowledge:

  • server owners are responsible for the operation, rules, and content of their servers
  • we do not control or guarantee the safety, availability, or accuracy of third-party servers
  • we may remove, suspend, or restrict listings that violate these Terms or create risk

8. Connected accounts and APIs

If you connect third-party accounts (for example, Discord, Twitch, YouTube), you authorise us to access and use information from those services according to your selected permissions and our Privacy Policy. Third-party services may change or discontinue their APIs, which may affect features. We are not responsible for third-party service outages or changes.

9. Purchases, paid features, and refunds

If we offer paid features, subscriptions, donations, digital goods, boosts, entitlements, or virtual/digital currency, you agree that the purchase and fulfilment terms are governed by our Refund Policy.

  • payments are processed by third-party payment providers and their terms apply
  • prices, inclusions, and renewal terms (if any) will be disclosed at purchase time
  • to the extent permitted by law, digital purchases may be non-refundable once delivered or activated
  • we may suspend Accounts that engage in chargebacks, payment fraud, or abuse

Subscription cancellation and any refund or remedy rules (including non-delivery, duplicate charges, and consumer law exceptions) are described in our Refund Policy.

Nothing in these Terms is intended to exclude non-excludable rights you may have under applicable consumer laws.

10. Intellectual property

The Services (excluding User Content) and all related software, designs, text, graphics, logos, and trademarks are owned by or licensed to HytaleANZ and are protected by applicable laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written permission, except as allowed by law.

11. Enforcement, moderation, and termination

We may (but are not required to) monitor, review, or remove content, and enforce these Terms. We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk, engaged in unlawful behaviour, or initiated chargebacks/payment disputes in a manner inconsistent with our policies.

Where relevant, consequences of chargebacks and disputes (including potential suspension and revocation of digital items) are described in our Refund Policy.

You may stop using the Services at any time. You can request Account deletion as described in our Privacy Policy.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components.

13. Limitation of liability

To the maximum extent permitted by law, HytaleANZ and its owners, operators, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services is limited to the greater of AUD $100 or the amount you paid to us (if any) for the relevant Services in the 12 months before the event giving rise to the claim.

Important: Some laws (including Australian Consumer Law and New Zealand consumer laws) may provide guarantees, warranties, or rights that cannot be excluded. Nothing in these Terms excludes those non-excludable rights.

14. Indemnity

You agree to indemnify and hold harmless HytaleANZ and its owners, operators, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your breach of these Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia, unless required otherwise by mandatory laws in your place of residence. You agree to submit to the exclusive jurisdiction of the courts located in Queensland for disputes relating to these Terms or the Services, except where prohibited by law.

16. Changes to Terms

We may update these Terms from time to time. The "Last updated" date shows when these Terms were last revised. Continued use of the Services after changes take effect means you accept the updated Terms.

We may also update our Refund Policy from time to time. If you purchase digital goods or services, the version of the Refund Policy in effect at the time of purchase will generally apply to that transaction, unless a change is required by law or is made for security or fraud prevention reasons.
